小球圈用户服务协议 Spherely User Service Agreement

您注册及/或使用小球圈平台账号即表示您认可并同意遵守以下条款，以及我们后续对条款随时所作的修改。若您对本协议存在疑问，或者无法接受全部或者部分条款，可通过本协议附则所列方式联系我们，在您未与我们沟通一致前，请停止注册及使用平台账号。

By registering and/or using a Spherely platform account, you acknowledge and agree to comply with the following terms and any subsequent modifications we may make. If you have questions about this Agreement or cannot accept all or part of its terms, please contact us via the methods listed in the supplementary provisions. Please stop registering and using the platform account until we reach a consensus.

请确认您已年满18周岁，或您已年满16周岁且依靠自己的劳动收入作为主要生活来源，否则请您在法定监护人陪同下仔细阅读本协议并决定是否接受本协议，或者停止注册及使用本协议项下的账号及服务。

Please confirm that you are at least 18 years old, or at least 16 years old and rely on your own labor income as your main source of livelihood. Otherwise, please read this Agreement carefully accompanied by your legal guardian to decide whether to accept it, or stop registering and using the account and services under this Agreement.

小球圈是向用户提供一种更便捷的网球生活分享平台，旨在为您提供便捷的网球视频剪辑、记录分享服务。

Spherely provides users with a convenient platform for sharing tennis life, aiming to provide you with convenient tennis video editing, recording, and sharing services.

用户需通过实名手机号注册小球圈账号，注册成功之后，小球圈会按系统规则自动分配给用户一个号码，该号码即为小球圈账号。用户需自行设置符合安全要求的密码。

Users must register a Spherely account using a real-name mobile phone number. After successful registration, Spherely will automatically assign a number to the user according to system rules, which serves as the Spherely account. Users must set a password that meets security requirements.

小球圈账号的性质是用户使用小球圈服务的凭证，小球圈账号的所有权属于小球圈，用户仅有账号的使用权。用户不得有偿或无偿转让小球圈账号，以免产生纠纷。用户应当自行承担由此产生的任何责任，同时小球圈保留追究上述行为人法律责任的权利。

The Spherely account is a credential for users to use Spherely services. The ownership of the Spherely account belongs to Spherely, and users only have the right to use the account. Users may not transfer the Spherely account for free or for profit to avoid disputes. Users shall bear any liability arising therefrom, and Spherely reserves the right to pursue legal responsibility against such actors.

小球圈为用户提供网球视频剪辑、分享、社交服务，包括但不限于：

Spherely provides users with tennis video editing, sharing, and social services, including but not limited to:

• 视频上传、编辑、剪辑功能Video uploading, editing, and clipping functions
• 图片上传、编辑功能Image uploading and editing functions
• 内容发布、分享功能Content publishing and sharing functions
• 社交互动功能（点赞、评论、转发）Social interaction functions (likes, comments, reposts)
• 个人主页管理Personal profile management
• 即时通讯服务Instant messaging services

内容使用授权 Content Usage Authorization

您理解并同意，当您在小球圈上传、发布视频、图片等内容时，您授权小球圈在全球范围内使用、复制、修改、改编、发布、翻译、创建衍生作品、传播、表演和展示此等内容（包括但不限于用于制作每周十佳球、精彩集锦等二次创作内容）。该授权为免费、不可撤销、永久性的，并且小球圈有权将上述权利转授权给第三方。

You understand and agree that when you upload or publish videos, images, and other content on Spherely, you authorize Spherely to use, copy, modify, adapt, publish, translate, create derivative works of, distribute, perform, and display such content worldwide (including but not limited to creating secondary content such as "Top 10 Shots of the Week" and highlight reels). This authorization is free, irrevocable, and permanent, and Spherely has the right to sub-license the above rights to third parties.

您保证上传的内容不侵犯任何第三方的知识产权、肖像权、隐私权等合法权益，如因您上传的内容引发任何纠纷或法律责任，由您独立承担。

You guarantee that the content you upload does not infringe upon the intellectual property rights, portrait rights, privacy rights, or other legal rights of any third party. You shall independently bear any disputes or legal liabilities arising from the content you upload.

用户在使用小球圈服务时，必须遵守中华人民共和国相关法律法规，不得利用小球圈服务进行任何违法或不当活动，包括但不限于：

When using Spherely services, users must comply with the relevant laws and regulations of the People's Republic of China and must not use Spherely services for any illegal or improper activities, including but not limited to:

• 发布违法、有害、威胁、滥用、骚扰、侵害、中伤、粗俗、猥亵、诽谤的内容Publishing illegal, harmful, threatening, abusive, harassing, infringing, defamatory, vulgar, obscene, or slanderous content
• 侵犯任何人的版权、商标权或其他知识产权Infringing on anyone's copyright, trademark rights, or other intellectual property rights
• 冒充任何人或实体，或以其他方式歪曲您与任何人或实体的关系Impersonating any person or entity, or otherwise misrepresenting your affiliation with a person or entity
• 发布任何您无权发布的内容Publishing any content you do not have the right to publish
• 发布包含病毒或其他有害代码的内容Publishing content containing viruses or other harmful code

用户违反上述规定的，小球圈有权立即停止提供服务，并保留追究法律责任的权利。

If a user violates the above regulations, Spherely has the right to immediately stop providing services and reserves the right to pursue legal responsibility.

小球圈的文字、图片、视频、音频、软件等元素，小球圈服务标志、标识以及专利权，小球圈对此享有上述所有内容的知识产权或已取得合法授权。

Spherely owns the intellectual property rights or has obtained legal authorization for elements such as text, images, videos, audio, software, service marks, logos, and patent rights of Spherely.

用户使用小球圈服务只能在本协议以及相应的授权许可协议授权的范围使用小球圈知识产权，未经授权超范围使用的构成对小球圈的侵权。

Users may only use Spherely's intellectual property within the scope authorized by this Agreement and corresponding license agreements. Unauthorized use beyond the scope constitutes infringement against Spherely.

小球圈服务按"现状"提供，我们不保证服务不会中断或没有错误。在法律允许的最大范围内，小球圈明确拒绝所有明示或暗示的保证，包括但不限于对适销性、特定用途适用性和非侵权性的暗示保证。

Spherely services are provided on an "as is" basis. We do not guarantee that the service will be uninterrupted or error-free. To the maximum extent permitted by law, Spherely explicitly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

用户理解，互联网技术的不稳定性，可能导致政府政策管制、病毒入侵、黑客攻击、服务器系统崩溃或者其他现今技术无法解决的风险发生，上述风险可能导致小球圈服务中断或账号道具损失，对此等非人为因素引起的损失小球圈不承担责任。

Users understand that the instability of internet technology may lead to risks such as government policy controls, virus intrusions, hacker attacks, server system crashes, or other issues that current technology cannot solve. These risks may cause Spherely service interruptions or loss of account items. Spherely assumes no responsibility for losses caused by such non-human factors.

小球圈重视用户隐私保护，具体的隐私收集、使用和保护措施请参阅《小球圈隐私政策》。

Spherely values user privacy protection. Please refer to the "Spherely Privacy Policy" for specific measures on privacy collection, use, and protection.

用户同意小球圈按照《小球圈隐私政策》收集、使用和保护用户信息。

Users agree that Spherely collects, uses, and protects user information in accordance with the "Spherely Privacy Policy".

本协议条款的签订、解释以及争议的解决均适用中华人民共和国法律。

The signing, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China.

若用户与小球圈发生争议的，双方同意将争议提交被告方住所地有管辖权的人民法院诉讼解决。

If a dispute arises between the user and Spherely, both parties agree to submit the dispute to the people's court with jurisdiction at the defendant's domicile for litigation.

本协议由小球圈公布，对小球圈具有法律约束力；用户一经点击接受或者直接登录、查看、发布、使用的行为视为对本协议的接受，对用户具有法律约束力。

This Agreement is published by Spherely and is legally binding on Spherely; user's act of clicking to accept, or directly logging in, viewing, publishing, or using constitutes acceptance of this Agreement and is legally binding on the user.
